Legal Case CA Attorney General Weighs In.

Bakersfield has a case about a Water District Killing fish by stopping flows in the Kern River. Attorney General Bonta is quoting old fishery protection laws in an Amicus Brief for the courts.

There are articles around about the case. It's argued that maintenance isn't an excuse to kill fisheries and other things.

I guess anyone who read about the Attorney General's amicus brief position aboutt this Kern river / Bakesrfield cases realizes he probably has no intent of havinng the same priniciples apply across all of our lakes and waterways. I do think it's impractical to say the down stream sides of all dams will have enough water to maintain a fishery. Some dams are being taken down fine, I guess, But miniimum pools almost always can be maintained and they are an undenialble benefit compared to draining them and letting them recover and draining them again like Sweetwater has done at Loveland and waterboards and DFW have condoned.
